TERMS AND CONDITIONS

 

1. GENERAL

The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as ”you”) with BeauBags VOF, hereinafter referred to as “BeauBags”, ”us ” or ”we”, at the BeauBags website, mobile website or via telephone (jointly referred to as ”www.beaubags.com”).

By using www.beaubags.com and/or placing an order, you agree to be bound by the terms and conditions set out herein (the ”Terms”). Please make sure you have read and understood the Terms before placing your order. 

Only persons 18 years or older, who are not under guardianship, can place an order. 

The inclusion of any products or services on www.beaubags.com at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.

We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be those on www.beaubags.com at the time you place your order.

2. PRICES AND DELIVERY CHARGES

All prices displayed at www.beaubags.com include the statutory Value Added Tax (VAT tax). For all countries in the EU we don't charge shipping costs. 

For shipping to the UK, things have changed since the Brexit came into effect.

As soon as the ordered amount is under 135 GBP (±155 EURO) we can not ship to the UK. Because a HMRC-Vat-number is required for order quantities below 135 GBP (±155 EURO) and we do not have a HMRC-Vat-number we cannot deliver your order. We apologise for any inconvenience.

As soon as the ordered amount is above 135 GBP (±155 EURO) we do ship to the UK with DPD. We will not charge additional shipping costs for delivery to the UK. We also do not charge VAT above 135 GBP (±155 EURO). You as a consumer have to pay the VAT, duties and customs clearance fee during the delivery process at the carrier. The delivery is provided by DPD and they will contact you about this.

Please keep in mind that all prices are retail prices and are stated in Euro. Prices do not include: taxes, duties, import fees charged by your local government, service, payment or delivery charges depending on country. If you are a Non-EU customer/resident, BeauBags does not charge VAT tax or any other taxes on your purchase.

Please be aware that if you decide not to pay the fees the package will have to be returned from the Uk to Europe. The cost of the return shipment, tax and import duties involved in importing the item back to Europe will then deduct from the order amount paid to us.

If a product does not meet your expectations, the shipping costs for returning will be at your own expense.

3. ORDER PROCESSING AND SHIPMENT

BeauBags will make every effort to process and deliver your order as well and as quick as possible after receiving full payment.

Orders are delivered to the shipping address indicated by you and via the means of delivery chosen by you. The delivery period as  shown on the website is an indication. External factors, such as internal availability as well as the payment and means of transport chosen by you, may affect the delivery period.

If you have an order delivered outside the European Union, it is possible that the country in question will charge additional levies such as import tax. BeauBags has no influence or control over such levies and will therefore not be able to inform you thereof. Before placing such an order, you must check yourself whether the items ordered by you can be exported to or imported in the country in question and what the cost is thereof.

Title to the products ordered by you is transferred to you at the moment of receipt of full payment by BeauBags.

BeauBags takes great care to ensure that its products are shipped correctly and completely. Should you unexpectedly receive incomplete or damaged products, please contact BeauBags immediately.

4. RETURNS

If for any reason you are not satisfied with the product you ordered, you have the right, without giving any reasons, within 60 days after receiving the product to indicate that you wish to terminate the contract with regard to the product in question. This concerns the so-called time to reconsider. You may use your termination right by using the return form as attached to your order. Instructions of how to return merchandise can also be found on our website.

BeauBags guarantees a full refund (exclusive import duties, taxes and customs charges) can be applicable to international shipmentsor if you prefer, to replace any returned items, provided that all items are returned in the same condition they were in upon your receipt. This means the items should not have been damaged, soiled, altered or worn (other than to try the item on) and that any labels or tags should be intact.

Returning orders is very simple. Request a return label at: www.beaubags.com/returnlabel. Please include your name, order number and the product(s) you want to return. You will then receive a DPD return label by e-mail within 24 hours. Print out the return label and paste it on the box. Make sure that the label we used to send your order is no longer visible. Check your information on the back and edit this if necessary. Include the return form with the product(s) you are returning. Bring the package to the DPD Pickup parcelshop and you will have your purchase amount returned to you automatically.

All items returned should include the completed returns note with an order reference number and your contact details. Unidentified returns may not be eligible for a refund. For faulty items BeauBags will make a full refund to you as soon as possible and at the latest within 7 days of receiving your notice of cancellation, provided we have received the items or evidence of you having sent back the items. 

Peel off the pre-paid returns label and attach to the outside of the parcel, making sure that you cover the original address label. 

Please hand the parcel in at your collection point. You are liable for lost or damage to the products until we receive them at our warehouse, so in case of a dispute, we recommend that you keep the collection point receipt as proof of postage.

5. PAYMENT

Payments can be made by Visa, MasterCard, American Express, Paypal, and Bank transfer. 

You confirm that the credit card that is being used is yours or that you have been specifically authorized by the owner of the credit card to use it. All credit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to LaDress, we will not be liable for any delay or non-delivery. 

We take all reasonable care to make www.beaubags.com secure. All card transactions on www.beaubags.com are processed using Ingenico ePayment, a secure online payment gateway that encrypts your card details in a secure host environment.  

To help ensure that your shopping experience is safe, simple and secure BeauBags uses Secure Socket Layer (SSL) technology. 

6. COLOURS

We make all reasonable efforts to accurately display the attributes of our products, including composition and colours. The colour you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colours. 

7. GUARANTEE

If there are defects in the goods you have purchased, BeauBags abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know by returning the goods to us without delay by using the provided pre-printed return form.

8. APPLICABLE LAW AND COMPETENT JURISDICTION

If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply. Dutch law applies exclusively to these Conditions and the contract entered into by you and BeauBags, with the exclusion of the UN Convention on the International Sale of Goods.The competent court in the Netherlands has the exclusive competence to hear and settle all disputes that might arise concerning these Conditions or the contract entered into by you and BeauBags.

9. OWNERSHIP OF RIGHTS 

All intellectual property rights, such as trademarks and copyrights at www.beaubags.com remain with BeauBags and its subsidiaries or licensors. Any use of www.beaubags.com or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of BeauBags.
